Muslim Law of Succession

The Muslim Law of succession is uncodified, there is no partition of inherited property.  Succession opens only on the death of the ancestor, and then alone the property vests in the heirs.  The Islamic Law of succession is inheritance only on the basis of sex.  Women have equal right to share the property of the deceased.

Christian Law of Succession

According to Section-32 of the Indian Succession Act, 1925 the property of an intestate devolves upon the wife or husband, or upon those who are of the kindred of the deceased, in the order and according to the rules hereinafter contained.  A widow will not be entitled to the provision hereby made for her if, by a valid contract made before the marriage she has been excluded from her distributive share of her husband's estate.

For all these and above reasons to apply for Legal Heir Certificate under the provisions of Indian Succession Act, 1925  the civil courts are only issue Legal Heir Certificates, where as the Tahsildhars are not competent to give Legal Heir Certificates and they will only competent to give Family Members Certificates to claim the dues from the government.

In Andhra Pradesh the Administrative General of A.P. is also competent to give Under Section-29 of Administrator General Act, 1963 as amended by the Administrator General Amendment Act No.34 of 1999 for which the if the Property value is below Rs.10,00,000/-.   If the Property value is above Rs.10,00,000/- you may approach Civil Court by filing appropriate Proceedings for remedial justice.

  1. Legal Heir Certificate is also known as Succession Certificate.
  2. According to the value of the Property the Succession Certificate/Legal Heir Certificate is two types.
  3. The Administrator General of Andhra Pradesh is the issuing authority of Legal Heir Certificate.
  4. For getting Legal Heir Certificate the applicant should furnish his/her particulars, details of the property etc., by giving an Affidavit.
  5. Consent Affidavit for No-objection.
  6. Two third party affidavits in Rs.10/- N.J. Stamp Paper.
  7. For Proof of Identity the applicant should furnish Ration Card/Voters ID Card/Pass Port/Service Proof  etc.
  8. Other original documents relating to the claim of the property.
  9. Petition praying what he/she is claiming.
